Processing of personal data and purpose, duration and legal foundation of processing:

Upon accessing our website www.kew-werke.de, the browser on your terminal device auto-matically transmits information to the server of our website. This information is stored tempo-rarily in a so-called logfile and is processed on the basis of art. 6 section (1) clause 1(a) (Consent) and (f) (Processing for safeguarding legitimate interests) of the regulation (EU) 2016/679 (General Data Protection Regulation, GDPR). In the course of this process, the following information can be collected and stored, without any action on your part, until the time of automatic deletion:

  • IP address of the requesting computer,
  • Date and time of the access,
  • Name and URL of the requested file,
  • Website, from which our website was accessed (Referrer URL),
  • Used browser and possibly the operating system of your terminal device as well as the name of your access provider.

Furthermore, our website uses so-called cookies (text files which are stored on your terminal device).

Data processing, including the use of cookies, takes place for the following purposes - legiti-mate interest:

  • Enabling a smooth connection of the website,
  • Safeguarding a user-friendly, comfortable, effective and safe use of our website,
  • Evaluation of the system security and stability as well as
  • For administrative purposes.

The IP addresses are pseudonymised. The data are not stored in a way that they can be traced back to an identifiable person.

Furthermore, we process personal data provided by you or collected by third parties - for example payment service providers. We do not collect personal data of specific categories from third parties.

If you contact us via our contact form, we will process the data provided by you in the form, such as name, address, phone number and e-mail address and company information, as the case may be.

We process personal data to the extent necessary for the processing of inquiries or precon-tractual measures requested by you, as well as for the performance of contractual relation-ships and for the fulfilment of the related legal obligations, particularly according to the Ger-man Commercial Code and provisions of public law, such as tax laws. The basis for this is art. 6 section (1) clause 1(b) (Processing for the fulfilment of a contract or of requests) and (c) (Processing for the fulfilment of legal obligations) of the GDPR.

Furthermore, we process personal data to the extent necessary for the performance (fulfil-ment or implementation) of non-contractual legal relationships - legitimate interest. The basis for this is art. 6 section (1) clause 1(f) of the GDPR (Processing for safeguarding legitimate interests).

We will process the personal data for the processing of which you have given your consent - either notification in the frame of enquiries or orders for the purpose of their processing -, for the fulfilment of the agreed purpose to the extent necessary. The basis for this is art. 6 sec-tion (1) clause 1(a) of the GDPR (Consent).

The data are processed to the extent necessary until the completion of the performance of the contractual or legal relationship, until the end of our legal obligations or for the effective period of consent (whichever of the relevant periods expires last).

“Session cookies” are deleted automatically after the end of your browser session. Cookies, which are no “session cookies”, remain on your terminal device until you delete them your-self. You can control, limit or prevent cookies in your web browser. It may be possible that our website only works in a limited way in this case.

Further processing of your personal data will not take place, unless there is an agreement to the contrary in this data protection declaration.

If the personal data which are necessary for the respective purpose are not provided, we are not able to fulfil the purpose within the legal sense.

Data subjects shall have the right of

  • Information on the processing of personal data according to art. 15 of the GDPR;
  • Correction or completion of personal data according to art. 16, 19 of the GDPR;
  • Deletion of personal data according to art. 17, 19 of the GDPR;
  • Limitation of the processing of personal data according to art. 18, 19 of the GDPR;
  • Transfer of personal data according to art. 20 of the GDPR;
  • objection to the processing of personal data according to art. 21 of the GDPR.

If you have given your consent to data processing, you can revoke your consent at any time, without affecting the legality of the processing prior to the revocation, which was based on your consent.

Data subjects may exercise all the rights mentioned above against our responsible office.

According to art. 77 of the GDPR, data subjects have the right of complaint to a supervisory authority, in particular in the Member State of their habitual residence, of their place of work or of the place of the suspected violation, if they believe that the processing of their personal data violates the GDPR.

Data transfer to third parties:

Personal data are only transferred to third parties, if you have given your consent (basis: art. 6 section (1) clause 1(a) of the GDPR), the transfer is necessary for the performance of the respective legal relationship or for the provision of our respective service (basis: art. 6 section (1) clause 1(b) (Processing for the fulfilment of a contract) (f) (Processing for safeguarding legitimate interests) of the GDPR) - legitimate interest - or if we are under a legal obligation to do so (basis: art. 6 section (1) clause 1(c) of the GDPR). Third parties may be, for example, payment or logistics service providers, IT providers or authorities. Further regulations of this data protection declaration shall remain unaffected by this.
